ONLINE ORDER SERVICE - TERMS & CONDITIONS
1. The
Service
1.1 The Online Order Service (="the Service") offers to the
subscribers the opportunity to order electronically, selected goods
and services, to receive information for the characteristics and the
current prices of goods and services, to get information on the
calling rates and to communicate with Cyta.
1.2 The Service is offered to individuals who have completed
the 18th year of age.
2. Submission of Orders
The subscribers can submit orders with the completion of an
application form which shall be sent electronically and can
thereafter check their order with the use of the “Reference Number”
which shall be assigned to them by Cyta.
3. Subscriber’s Obligations
3.1 The Subscribers are liable for any acts connected to the
use of the Service.
3.2 The Service and any information provided or exchanged
must comply with the Telecommunications and Postal Regulation Act
and the Telecommunications Service Regulations.
Without prejudice to the generality of these terms, any acts which
include the following, shall be prohibited:
(a) any act that endangers the security of the State and/or public
order and/or is in breach with the current laws or good morals,
(b) the harassment of persons,
(c) the use of telecommunications in a way incompatible to their
purpose,
(d) any act that omits anything provided by law,
(e) any act that constitutes a criminal offence or instigates to
commit a criminal offence,
(f) any act that constitutes tort against person or instigates tort
against any person,
(g) anything that has immoral content or instigates immoral
behaviour or has sexual meaning or content,
(h) anything that offends the faith and/or the principles and/or the
religion of a person,
(i) anything that offends the constitutional rights of a person,
(j) anything that harms Cyta’s good name,
(k) anything that is racious or discriminatory,
(l) anything that refers to the activities of a famous person on
implies anonymously a person without his/her consent or interferes
to the privacy of any person,
(m) anything that instigates any person to get involved in dangerous
acts or use dangerous substances.
4. Protection of Personal Data
Cyta undertakes to take all necessary measures for the protection of
the confidentiality of the subscriber’s personal data which are
submitted or are transmitted via the Service and is committed to
comply with the Cyta Policy or Data Protection and Confidentiality.
5. Limitation of Liability
5.1 Cyta shall not be liable for any advertisement, services
or goods or any material that is provided via the Service or for any
demand which is connected to the Service or the use of the Service.
The subscriber shall be liable for all the above.
5.2 Cyta shall not be liable for any direct, indirect,
exemplary, consequential or punitive damages, for the loss of
profits or reputation or any other damage which results from:
(a) the use or the inability to use the Service,
(b) any products, data, information or services received through the
Service,
(c) access to the Service without authorisation or demand of data,
(d) any demand related to the use of software.
5.3 Cyta shall not be liable for any non provision or delay
or provision of goods or services which is due to the fact that the
subscribers provided false or incomplete information and/or data to
Cyta, for the accuracy of which the subscribers shall remain solely
liable.
6. Indemnity
The subscriber shall indemnify and hold Cyta harmless from and
against all suits or claims, including legal fees, that may be
brought against it by third parties resulting from any cause of suit
related to the use of the services or otherwise from the use of
software or the content of the information or the advertisements.
Provided that in any such case Cyta shall notify the subscriber for
the suit or claim and shall give the subscriber any opportunity and
assistance for the defence of such suit or claim and shall not make
an admission or compromise or any other act that may prejudice such
defence without the approval of the subscriber unless the subscriber
fails to defend such suit or claim within fifteen (15) days from the
date on which he is notified of any such suit or claim.
7. Warranties
Cyta makes no express or implied warranty, including but not limited
to, any implied warranty for merchantability or fitness for purpose.
In particular, Cyta does not warrant that the Service will not be
interrupted, shall be timely, secured, error free or that the
Service will be available in any time or place.
8. Intellectual Property
8.1 The Service and the software of the Service contains information
which are protected by the intellectual property laws.
8.2 The subscribers/users are not allowed to copy, reproduce or
distribute in any way the content of the Service or to create any
products resulting from the content of the Service, without the
express authorisation of Cyta or any publisher of the content.
9. Amendment/Termination
9.1 Cyta reserves the right to upgrade, amend or suspend the
Service.
9.2 Cyta reserves the right to discontinue access to the
Service in case of breach of the present terms and conditions.
10. Applicable Law
The present terms and conditions shall be governed by the laws of
Cyprus and the parties submit to the jurisdiction of Cyprus Courts.
ebill – TERMS & CONDITIONS
1. DESCRIPTION OF THE SERVICE
ebill (=the Service) provides the possibility to all customers of
the Cyprus Telecommunications Authority (Cyta) subscriber services
to manage their bills electronically through the Internet for all
services provided to them by Cyta.
2. ACCESS TO THE SERVICE
2.1 The Subscriber gains access to the Service through the use of a
username and a password provided by Cyta. Upon submission of an
application for access to the Service, the Subscriber receives a
password by post. The Subscriber is requested to alter this
password immediately upon first use. The Subscriber is exclusively
responsible for keeping his password confidential and will be solely
liable for any activities carried out with the use of this password.
The password is personal, non-transferable and non-negotiable.
2.2 In the event of unauthorised use, loss or theft of the password,
the Subscriber should inform Cyta.
3. USE OF THE SERVICE
3.1 The Subscribers may not use the Service to take any actions that:
(a) Transmit and/or transfer in any way information and content that
is illegal, harmful, threatening, insulting, violent, offensive,
defamatory or libellous, fraudulent, pornographic or obscene or that
infringes on any third party’s privacy or that is indecent or
inappropriate in any way.
(b) Discriminate, downgrade or insult an individual or a group of
people on the basis of religion, gender, race, nationality, age or
disability.
(c) Cause harm to under-age individuals in any way
(d) Infringe on any third party’s patent, copyright, trademark or
service trademark or trade secret or other proprietary rights.
(e) Collect, use, store or control any third party’s personal data.
(f) Violate the Constitution, or any Law or international Convention
which applies in the Republic of Cyprus.
4. CONFIDENTIALITY
4.1 Subscribers shall be called upon to register by completing a
relevant application. In such a case, they shall be requested to
provide information such as name, customer number, ID number,
electronic mail address, contact telephone number. Subscribers have
the obligation to provide true, reliable, up-to-date and complete
information about themselves.
If Cyta has well-founded suspicions that the
information provided is false, inaccurate, not recent or incomplete,
it shall have the right to deny or terminate access to the
Subscriber in question, without any prior notice.
4.2 Cyta shall take all necessary measures to protect Subscribers’
confidentiality. All the information and data provided upon
registration shall be protected and shall not be transferred to
third parties. Data revealing the identity, such as the name, the
address, e-mail address, telephone number or other data shall not be
disclosed or transferred by Cyta to third parties without the
Subscribers’ consent.
4.3 Cyta may reveal information and data if this is required by law,
or by a Court ruling, or by a decision taken by a competent
Authority.
5. COMPENSATIONS
Subscribers shall indemnify and protect from all prejudice Cyta, its
associated companies, shareholders, officials, directors, employees,
authorised representatives or successors for any demand, legal
action or grounds for action, loss of liability, cost and expenses,
including legal fees, arising from a breach of the present Terms and
Conditions, for the duration of the present Agreement and following
its termination.
6. DISCLAIMER
6.1 Cyta (including its officials and employees) disclaim all
liability of any kind, direct, indirect, exemplary, incidental,
special or consequential damages for loss of income, reputation or
any other damages arising from:
(a) The use or inability to use the Service.
(b) Any products, data, information or services obtained or accessed
through the Service.
(c) Unauthorised access to data or amendment of data.
(d) Demands associated with the use of software.
(e) Breach of any rights of any person of any nature, which occurs
or is being attempted through the Service.
(f) Interruption of service or disconnection of Subscribers
6.2 Cyta is not responsible in the event of access to the Service as
a result of using a Subscriber’s password without prior
authorisation or following the loss or theft of a Subscriber’s
password.
6.3 Cyta shall not be responsible in any way for any damages or loss
of any kind, which may be caused by transferring data from the
Service or accessing the Service contents.
6.4 Cyta disclaims all warranties of any kind, express or silent,
including implied warranties of merchantability or fitness for any
specific purpose. In particular, Cyta does not provide any kind of
guarantee for continuous, uninterrupted, on-time, secure and
infallible provision of Service and it does not warrant that the
Service will be available at any time or place.
6.5 Cyta is not responsible for any defamation in connection with a
person or products or services or for any infringement of copyright
or for contempt of Court or for any infringement of any person’s
privacy or for breach of contract or for committing a civic offence
or for any violation or offence committed or attempted through the
Service.
7. TERMINATION OF THE SERVICE
7.1 Cyta reserves the right to:
(a) Interrupt, upgrade, amend or temporarily or permanently suspend
the Service, or the Subscriber’s account (including the password),
or to bar or refuse or stop the use or access to the Service.
(b) Amend the present Terms and Conditions for the Provision of the
Service.
8. TRADEMARKS, COPYRIGHT
8.1 The Service and the Service software contain information which
is protected by the legislation on copyright, trademarks, service
trademarks, patents or other proprietary rights.
8.2 Subscribers may not copy, reproduce, or make in any way
available the contents of the Service, or create products derived
from the contents of the Service, without the express authorisation
from Cyta.
